SC asks why Kerala wants to withdraw plea to reinstate UAPA against Roopesh – Mathrubhumi English

New Delhi: The Supreme Court of India on Monday asked the Kerala government to explain the reason behind withdrawing its plea to reinstate UAPA charges against Maoist leader Roopesh. The bench headed by Justice MR Shah said the plea can be allowed only if the reason is valid.
The state has time till Friday to file the response.
SC had earlier sent notice to Roopesh in the plea of Kerala government seeking permission to reinstate the UAPA charges in the cases registered at Valayam and Kuttiady police stations. The government then decided to withdraw the plea. But it had not explained the reason behind the decision in the plea.
SC bench said the HC scrapped the charges citing mere technical reasons and it cannot allow the withdrawal plea unless it knows the reason.
Roopesh is booked for distributing the leaflets of banned organisations. However, HC scrapped UAPA charges citing delay in approval for prosecution.
